Specifically, it is ordered that defendant Allstate Insurance Company is granted summary judgment as to Plaintiff's claim for insurance bad faith and the corresponding request for punitive damages, but that the motion for summary judgment is DENIED in all other respects. On November 15, 22 2011, plaintiff filed objections to the findings and recommendations (ECF No. 109), and on 23 December 2, 2011, defendant Allstate filed a response to plaintiff’s objections (ECF No. 110), 24 all of which have been considered by the court. 25 26 In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C) and Local Rule 304, this court has conducted a de novo review of this case. Having carefully reviewed the file, 1 1 the court finds the findings and recommendations to be supported by the record and by the 2 proper analysis. 3 Accordingly, IT IS ORDERED that: 4 1.
