ORDER signed by Judge John A. Mendez on 2/15/2011 re 14 ORDERING that All claims in the First Amended Complaint against Defendant Will Richmond, are DISMISSED WITH PREJUDICE and he is dismissed as a Defendant in this case. Plaintiffs' Second, Third, Fourth, Fifth, Sixth, Seventh and Eighth Causes of Action are DISMISSED WITH PREJUDICE and Lisa Fontana is dismissed as a Plaintiff in this case. The parties are ordered to submit a Joint Status Report within twenty (20) days of this Order s etting forth their respective positions as to whether Plaintiffs First Cause of Action in the First Amended Complaint is still viable as to the Defendants other than WILL RICHMOND. Defendants did not raise any specific arguments in their motion as to the First Cause of Action and, therefore, the Court needs further briefing on this issue.(Duong, D)
