By order filed August 9, 2010, the court granted plaintiff twenty-eight days to file an amended complaint. In the August 9th order, the court informed plaintiff of the deficiencies in his complaint. On September 3, 2010, plaintiff was granted an extension of time until October 4, 2010, to submit his amended complaint. To date, plaintiff has not filed an amended complaint or otherwise responded to the court's order. For the reasons given in the August 9, 2010, order, IT IS HEREBY ORDERED that this action is dismissed with prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b).
