Plaintiff's original pleading is prepared on the form for a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. However, review of the allegations of the petition demonstrates that plaintiff is challenging conditions of his confinement rather than the fact or duration thereof . Accordingly, the action is construed as a civil rights action pursuant to 42 U.S.C. § 1983. See Wilwording v. Swenson, 404 U.S. 249, 251 (1971). Good cause appearing, plaintiff's original pleading will be dismissed with leave to file an amended complaint on the form provided with this order. Plaintiff has neither filed an in forma pauperis affidavit or paid the required filing fee. See 28 U.S.C. §§ 1914(a), 1915(a). Finally, plaintiff has filed a motion for appointment of counsel. The United States Supreme Court has ruled that district courts lack authority to require counsel to represent indigent prisoners in § 1983 cases. Mallard v. United States Dist. Court, 490 U.S. 296, 298 (1989). In certain exceptional circumstances, the court may request the voluntary assistance of counsel pursuant to 28 U.S.C. § 1915(e)(1). Terrell v. Brewer, 935 F.2d 1015, 1017 (9th Cir. 1991); Wood v. Housewright, 900 F.2d 1332, 1335-36 (9th Cir. 1990). In the present case, the court does not find the required exceptional circumstances. Plaintiff's motion for the appointment of counsel will therefore be denied. In accordance with the above, IT IS HEREBY ORDERED that: 1. This action is construed as a prisoner civil rights action pursuant to 42 U.S.C. § 1983; 2. Plaintiff's original pleading is dismissed with leave to file a civil rights complaint within thirty days from the date of this order; the amended complaint must be prepared on the form provided with this order, must bear the docket number assigned this case and must be labeled "Amended Complaint"; plaintiff must file an original and two copies of the amended complaint; failure to file an amended complaint in accordance with this order will result in a recommendation that this action be dismissed. 3. Plaintiff shall submit, within thirty days from the date of this order, an affidavit in support of his request to proceed in forma pauperis on the form provided by the Clerk of Court, or the appropriate filing fee; 4.
