MARTEL et al., Defendants. 17 ----oo0oo---- 18 19 The Final Pretrial Conference in this case is set for 20 June 8, 2015, at 2:00 p.m. in Courtroom No. 5. 21 shall be attended by at least one of the attorneys who will 22 conduct the trial for each of the parties and by any 23 unrepresented parties. 24 The conference Counsel for all parties are to be fully prepared for 25 trial at the time of the Pretrial Conference, with no matters 26 remaining to be accomplished except production of witnesses for 27 oral testimony. 28 Conference, counsel shall file separate pretrial statements. Fourteen days prior to the scheduled Pretrial 1 In 1 the pretrial statements, counsel shall address the following 2 matters, under the following captions and in the following order: 3 (1) Jurisdiction and Venue. The factual and statutory 4 basis of federal jurisdiction and venue and whether there is any 5 dispute concerning jurisdiction or venue. 6 (2) Jury / Non-Jury. Whether the party has demanded a 7 jury trial of all or any of the issues or, if not, whether a 8 demand for jury trial made by any other party is conceded or 9 contested. If the case is to be tried to a jury, the parties 10 shall also prepare a succinct statement of the case, which is 11 appropriate for the court to read to the jury. 12 (3) Remaining Claims. A list of the remaining claims 13 as against each defendant and any remaining affirmatively pled 14 defenses thereto. 15 16 17 (4) Trial Estimate. The estimated number of trial days. (5) Dispositive Motions. A plain, concise statement 18 that identifies every non-discovery motion that has been made to 19 the court and its resolution. 20 21 22 (6) Relief Sought. The elements of monetary damage, if any, and the specific nature of any other relief sought. (7) Witnesses. A list (names and addresses) of all 23 prospective witnesses, whether offered in person or by deposition 24 or interrogatory, designating those who are expert witnesses. 25 Only witnesses so listed will be permitted to testify at the 26 trial, except as may be otherwise provided in the pretrial order. 27 28 (8) Exhibits - Schedules and Summaries. A list of documents or other exhibits that the party expects to offer at 2 1 trial. 2 at trial except as may be otherwise provided in the pretrial 3 order. 4 Only exhibits so listed will be permitted to be offered (9) Discovery Documents. A list of all portions of 5 depositions, answers to interrogatories, and responses to 6 requests for admission that the party expects to offer at trial. 7 (10) Further Discovery or Motions. 8 further discovery or pretrial motions. 9 (11) Stipulations. Any requests for Any stipulations requested or 10 offered for pretrial or trial purposes. 11 (12) Amendments - Dismissals. Any requested amendments 12 to pleadings, dismissals, additions or substitutions of parties, 13 or dispositions as to defaulting parties. 14 (13) Settlement Negotiations. A statement whether 15 settlement negotiations between parties and/or a court settlement 16 conference would be helpful. 17 (14) Attorneys’ Fees. A statement whether attorneys’ 18 fees are sought and the time and manner in which they are to be 19 ascertained. 20 (15) Trial Exhibits. Any special handling of trial 21 exhibits and a statement of advisability of court retention of 22 exhibits pending appeal decision. 23 (16) Miscellaneous. Any other appropriate comments, 24 suggestions, or information that might aid in the disposition of 25 the action, including the identification of any writs necessary 26 to ensure the presence of plaintiff or witnesses at trial and any 27 matters set forth in Federal Rule of Civil Procedure 16(c). 28 Upon filing the Pretrial Statement, counsel shall also 3 1 email an electronic copy in Word to the undersigned’s courtroom 2 deputy, Karen Kirksey Smith, at KKirkseySmith@caed.uscourts.gov. 3 The trial is set for August 11, 2015, at 9:00 a.m. 4 IT IS SO ORDERED. 5 Dated: January 27, 2015 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4
