On March 6, 2014, the magistrate judge filed findings and recommendations herein which
21
were served on the parties and which contained notice that any objections to the findings and
22
recommendations were to be filed within fourteen days. No objections were filed.

The court has reviewed the applicable legal standards and, good cause appearing,
concludes that it is appropriate to adopt the proposed Findings and Recommendations in full.

Accordingly, IT IS ORDERED that:
26
1. The proposed Findings and Recommendations filed March 6, 2014, are ADOPTED;
27
2. Plaintiff’s motion to dismiss defendant Smith’s counterclaims, ECF No.
28
78, is granted;

3. Defendant Smith’s counterclaim is dismissed in its entirety with leave to amend; and
2
4. Defendant Smith is granted 30 days from the date of this order to file an amended
3
pleading curing the deficiencies identified in the magistrate judge’s findings and
4
recommendations.
