(Dkt. No. 197.) No objections were filed. Accordingly, the court 18 presumes any findings of fact are correct. See Orand v. United States, 602 F.2d 207, 208 (9th 19 Cir. 1979). The magistrate judge’s conclusions of law are reviewed de novo. See Britt v. Simi 20 Valley Unified School Dist., 708 F.2d 452, 454 (9th Cir. 1983). 21 The court has reviewed the file and finds the findings and recommendations to be 22 supported by the record and by the magistrate judge’s analysis. Accordingly, IT IS HEREBY 23 ORDERED that: 24 1. The findings and recommendations (dkt. no. 197) are adopted in full; 25 2. Defendants Mode and Yarrington’s motion to dismiss for lack of personal 26 jurisdiction (dkt. no. 179) is GRANTED IN PART and plaintiff’s claims against defendants 1 1 Mode and Yarrington are SEVERED under Fed. R. Civ. P. 21 and TRANSFERRED to the 2 United States District Court for the District of Vermont. 3 3.
