BJORLIN, Plaintiff, vs. MORROW, et al., Defendants. / Plaintiff, a state prisoner proceeding pro se, has filed a civil rights action pursuant to 42 U.S.C. § 1983 and application to proceed in forma pauperis. Plaintiff filed this action on August 18, 2010, however court records indicate that plaintiff filed the exact same case on August 13, 2010, CIV S-10-2162 FCD KJN.1 Due to the duplicative nature of the present action, the court finds this action frivolous and, therefore, will recommend that this action be dismissed. Adams v. Cal. Dept. of Health Services, 487 F.3d 684, 688 (9th Cir. 2007); 28 U.S.C. § 1915(d). IT IS HEREBY RECOMMENDED that this action be dismissed as duplicative These findings and recommendations are submitted to the District Judge assigned to this case pursuant to the provisions of 28 U.S.C. § 636(b)(l). The document should be captioned "Objections to Magistrate Judge's Findings and Recommendations." Any response to the objections shall be filed and served within fourteen days after service of the objections.
