This case is related to IconFind, Inc. v. Yahoo!, Inc., Case No. 2:09-cv-109-WBS-JFM, which was filed in this District on January 13, 2009 (the "Yahoo! Matter"). In the Yahoo! Matter, IconFind, Inc. ("Iconfind") filed suit against Yahoo!, Inc., asserting that Yahoo!'s Flickr website (i.e., a photo-sharing website) infringed U.S. Patent No. 7,181,459 7 8 9 10 11 12 13 14 Yahoo! Dated: March 24, 2011 Respectfully submitted, KAYE SCHOLER LLP part, against similar technologies (e.g., Google's Picasa website, a photo-sharing website), and given Judge Shubb's familiarity with the claims of the asserted patent resulting from his presiding over the Yahoo! Matter, Google believes that reassignment to Judge Shubb would conserve judicial resources and provide other economies. (i.e., the patent-in-suit in the instant matter). The Yahoo! Matter was assigned to Judge William B. Shubb. A claim construction hearing, presided over by Judge Shubb, was heard in that matter on December 7, 2009. The Yahoo! Matter was resolved shortly thereafter, with a stipulation and order of dismissal filed on March 26, 2010. The current suit involves the same plaintiff, the same patent-in-suit, and IconFind is represented by the same law firms as in the Yahoo! Matter. Because the patent-in-suit in the
