IconFind's motion was directed at Defendant Google Inc.'s ("Google") original Answer and

Counterclaims (Dkt. No. 18). After IconFind filed its motion, Google filed its First Amended

Answer to Plaintiff's Complaint For Patent Infringement and Counterclaims. (Dkt. No. 27).

Thus, IconFind hereby withdraws its motion to dismiss and strike without prejudice, specifically

reserving its right to answer or otherwise respond to Google's amended pleading. Accordingly,

there is no longer a need to proceed with the scheduled hearing on IconFind's motion currently
5
set for Monday, May 2, 2011 at 9:00 a.m.
