JOHN-CHARLES, 11 12 13 Plaintiff, No. CIV S-11-0568 KJM GGH P vs. GARY SWARTHOUT, et. al., 14 Defendants. 15 FINDINGS & RECOMMENDATIONS / 16 By order filed June 17, 2011, the court granted plaintiff twenty-eight days to file a 17 second amended complaint. In the June 17th order, the court informed plaintiff of the 18 deficiencies in his first amended complaint. The twenty-eight day period has now expired, and 19 plaintiff has not filed a second amended complaint or otherwise responded to the court’s order.1 20 21 For the reasons given in the June 17th, order, IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b). 22 These findings and recommendations are submitted to the United States District 23 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
