On November 2, 2011, defendant Swarthout filed a motion to dismiss pursuant to
17
Rule 12(b)(6) of the Federal Rules of Civil Procedure. Plaintiff had not opposed the motion, so
18
on December 15, 2011, the court issued an order to show cause ordering plaintiff to file an
19
opposition, if any, to defendant’s motion to dismiss within thirty days. Plaintiff has since filed an
20
opposition to defendant’s motion, and defendant Swarthout has filed a reply.
21
Good cause appearing, IT IS HEREBY ORDERED that the court’s order to show
22
cause is discharged.
