Petitioner, a state prisoner at Kern Valley State Prison, filed a document styled

“motion,” seeking an extension of time to file an application for writ of habeas corpus.1 No other
18
pleadings have been filed by the petitioner. On April 22, 2011, plaintiff was informed that he
19
must file an actual petition or this action would be dismissed. On May 27, 2011, petitioner
20
withdrew his filing and has not yet filed a petition with the court. Therefore, this action is
21
dismissed without prejudice.
