Moulds on 2/6/12 ORDERING service is appropriate for the following defendants: Bank of America, Reconstruct Company, Mortgage Electronic Registration Systems, Inc., American HomeMortgage Corp and FEPRS, LLC.; the Clerk of the Court shall send plaintiff 5 USM-285 forms, 1 summons, an instruction sheet and a copy of the amended complaint filed 11/22/11. Within 30 days from the date of this order, plaintiff shall complete the attached Notice of Submission of Documents and submit the following documents to the U.S. Marshal: the completed Notice of Submission of Documents; 1 completed summons; 1 completed USM-285 form for each defendant listed in number 1 above; and 6 copies of the endorsed amended compla int filed November 22, 2011. Plaintiff need not attempt service on defendants and need not request waiver of service. Within 10 days of submission of the documents to the U.S. Marshal, plaintiff shall file a statement with the court that said documents have been submitted. Plaintiff is proceeding in this action pro se. By order filed November 8, 2011,
16
plaintiff’s complaint was dismissed with leave to file an amended complaint. Plaintiff has now
17
filed an amended complaint.

Pursuant to 28 U.S.C. § 1915(e)(2), the court is directed to dismiss the case at any
19
time if it determines the allegation of poverty is untrue, or the action is frivolous or malicious,
20
fails to state a claim on which relief may be granted, or seeks monetary relief against an immune
21
defendant. The court cannot make this determination on the present record. Therefore, the court
22
reserves decision on these issues until the record is sufficiently developed.
23
In accordance with the above, IT IS HEREBY ORDERED that:
24
1. Service is appropriate for the following defendants: Bank of America,
25
Reconstruct Company, Mortgage Electronic Registration Systems, Inc., American Home
26
Mortgage Corp and FEPRS, LLC.

2. The Clerk of the Court shall send plaintiff 5 USM-285 forms, one summons,

3. Within thirty days from the date of this order, plaintiff shall complete the
