III. JURISDICTION/VENUE
Jurisdiction is predicated upon the American National

Red Cross’s chartered power to “sue and be sued” in federal

court, Am. Nat’l Red Cross v. S.G., 505 U.S. 247, 257 (1992).

Venue is undisputed and is hereby found to be proper.

IV.
DISCOVERY

The parties agreed to serve the initial disclosures

required by Federal Rule of Civil Procedure 26(a)(1) by no later

than November 7, 2011.
