This proceeding was referred to this court by Local Rule 302 pursuant to 28 U.S.C. 18 § 636(b)(1) and is before the undersigned pursuant to plaintiff’s consent. See E.D. Cal. Local 19 Rules, Appx. A, at (k)(4). On October 12, 2012, the court directed plaintiff to, within 30 days, submit documents 20 21 for service of process or file an amended complaint. The time for acting had passed and plaintiff 22 has not submitted the materials necessary to serve process, nor has he filed an amended 23 complaint or otherwise responded to the court’s order.
