On January 13, 2012, the court dismissed plaintiff’s complaint for failure to state 18 a cognizable claim and for failure to comply with Rule 8 of the Federal Rules of Civil Procedure. The dismissal order explained the complaint’s deficiencies, gave plaintiff 30 days to file 19 20 an amended complaint correcting those deficiencies, and warned plaintiff that failure to file an 21 amended complaint would result in a recommendation that this action be dismissed for failure to 22 state a claim. On April 19, 2012, plaintiff was granted an additional thirty days in which to file 23 his amended complaint. The 30-day period has expired and plaintiff has not filed an amended complaint or 24 25 otherwise responded to the court’s order. 26 //// 1 1 2 3 4 Accordingly, it is hereby ORDERED that Clerk of the Court randomly assign a United States District Judge to this case. Further, it is hereby RECOMMENDED that this action be DISMISSED for failure to prosecute and failure to state a claim. Fed. R. Civ.
