PRIETO, YOLO COUNTY SHERIFF, Defendants. / 18 Pending before the court are three motions: plaintiff’s 19 Amended Motion to Appoint Herman Franck as Guardian ad Litem for 20 plaintiffs Alex Franck and Adam Franck, ECF No. 41; plaintiff’s 21 motion for a preliminary injunction, ECF No. 22, and defendants’ 22 motion to dismiss the Second Amended Complaint. 23 On January 12, 2012, this court DENIED plaintiff’s original 24 application for appointment of a guardian ad litem, and stayed the 25 other two motions pending appointment of guardian ad litem for the 26 plaintiffs. The court vacated the hearing dates on the other 1 1 motions. 2 application to be appointed guardian ad litem, and he did so. The 3 court is now satisfied with the appointment of Mr. Franck as 4 guardian ad litem for Alex Franck and Adam Franck, who are minors. 5 The court granted Mr. Franck leave to file a new Accordingly, the court ORDERS as follows: 6 [1] Plaintiff’s application, ECF No. 41 is GRANTED. 7 Herman Franck is hereby appointed as guardian ad litem 8 for Alex Franck and Adam Franck. 9 [2] A hearing on the two pending motions, ECF Nos. 22 10 and 34 is SET for April 9, 2012 at 10:00 a.m. The court 11 considers briefing to be complete on both motions. 12 IT IS SO ORDERED. 13 DATED: March 16, 2012. 14 15 16 17 18 19 20 21 22 23 24 25 26 2
