QUAIR, SR., 11 Plaintiff, 12 vs. 13 No. CIV S-11-2293 CKD P GERTZ, Sheriff, 14 Defendant. 15 ORDER / 16 Plaintiff is a state prisoner proceeding pro se and in forma pauperis pursuant to 42 17 U.S.C. § 1983. On April 3, 2012, plaintiff filed a motion seeking subpoena forms so that he 18 could obtain statements from defendants, medical records, and other documents. (Dkt. No. 38.) 19 Per the scheduling order, the parties may conduct discovery until June 15, 2012, and all requests 20 for discovery pursuant to Fed. R. Civ. P. 31, 33, 34 or 36 shall not be served later than sixty days 21 prior to that date. (Dkt. No. 32.) Plaintiff is advised that these Rules set forth the procedures for 22 obtaining documents and statements from defendants; subpoenas are not appropriate at this stage 23 of the proceedings. Therefore plaintiff’s motion will be denied. However, in light of plaintiff’s 24 need for clarification of the discovery process, the deadline for discovery requests shall be 25 extended for 14 days after service of this order. 26 \\\\\ 1 1 Accordingly, IT IS HEREBY ORDERED that: 2 1.
