According to petitioner’s affidavit submitted in support of his 21 application, he had a balance of $636.60 as of August 26, 2011, eighteen days before he filed his 22 petition. The fee for filing a habeas action is only $5.00. Accordingly, the motion to proceed in 23 forma pauperis will be denied. See 28 U.S.C. § 1915(a). 24 \\\\ 25 \\\\ 26 \\\\ 1 1 Petitioner will have thirty days from the entry of this order in which to submit the 2 filing fee of $5.00. Failure to submit the fee will result in dismissal of this action under 3 Fed.R.Civ.P. 41(b).1 4 In accordance with the above, IT IS HEREBY ORDERED that: 5 1. Petitioner’s motion to proceed in forma pauperis (Docket No. 3) is denied; 6 2. Petitioner has thirty days from the entry of this order in which to submit the 7 $5.00 filing fee.
