The ex parte application to amend the complaint by substituting out fictitiously named

defendants, Doe 3 through Doe 11, for the names of real defendants, made by plaintiffs

THOMAS T. AOKI, M.D. and AOKI DIABETES RESEARCH INSTITUTE in the above-
23
captioned matter, is hereby GRANTED. As requested, the following defendants shall be
24
substituted in for the Doe defendant identified hereinbelow with respect to all claims asserted in
25
the plaintiffs’ complaint with the exception of the Sixth and Seventh Claim for Relief. In
26
addition, the Court Clerk shall issue a Summons identifying the substituted defendants which
27
have been specifically named hereinbelow in order so that the plaintiffs may execute service of
28
process thereon.
