The thirty day period has now expired, and 19 plaintiff has not filed an amended complaint or otherwise responded to the court’s order. 20 Plaintiff has neither consented to nor declined magistrate judge jurisdiction in this matter. 21 Therefore, the Clerk of Court will be directed to randomly assign a district judge to this action. 22 23 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court is directed to randomly assign a United States District Judge to this action. 24 Furthermore, IT IS HEREBY RECOMMENDED that this action be dismissed 25 without prejudice. See Local Rule 110; FED . R. CIV .
