On June 26, 2012, the court closed this case as frivolous and for 19 failure to state a claim. On July 20, 2012, the court denied plaintiff’s motion pursuant to Fed. R. 20 Civ. P. 60(b). Plaintiff filed an appeal with the Ninth Circuit and on September 26, 2012, the 21 Ninth Circuit referred the matter back to this court for the limited purpose of determining 22 whether plaintiff’s in forma pauperis status should continue for the appeal or whether the appeal 23 is frivolous or taken in bad faith. For the reasons set forth in the prior courts orders (Docs. 4, 9), 24 the court finds that plaintiff’s appeal is frivolous. Hooker v. American Airlines, 302 F.3d 1091, 25 1092 (9th Cir. 2002). Therefore, plaintiff’s in forma pauperis status is revoked. 26 //// 1 1 Accordingly, IT IS HEREBY ORDERED that: 2 1. Plaintiff’s in forma pauperis status is revoked; 3 2.
