On March 19, 2012, 18 respondent filed a motion to dismiss. Respondent contends that the petition before the court is a 19 mixed petition containing both exhausted and unexhausted claims. On June 4, 2012, petitioner 20 filed a document styled as an opposition to the motion to dismiss. Therein, petitioner requests 21 that this action be stayed and held in abeyance pending exhaustion of unexhausted claims or, in 22 the alternative, that petitioner be granted leave to amend the petition to proceed with the 23 exhausted claims. 24 ///// 25 ///// 26 ///// 1 1 Good cause appearing, IT IS HEREBY ORDERED that within fourteen days from 2 the date of this order respondent shall file and serve a response to petitioner’s request for stay and 3 abeyance.
