Plaintiffs filed a First Amended Class Action Complaint (“Complaint”) against Defendant

Whirlpool Corporation (“Whirlpool”) on September 25, 2012. Defendant filed a Motion to

Dismiss Plaintiffs’ Complaint Pursuant to Fed. R. Civ. P. 12(b)(6) on October 15, 2012. (Dkt. No.

4

59). The motion is set for hearing before this Court on December 5, 2012 at 9:30 a.m.

5

Plaintiffs’ counsel conferred with Defendant’s counsel on November 7, 2012 regarding a

6

continuation of the December 5 hearing date, and an extension of time for the parties to file

7

opposition and reply briefs. Pursuant to Eastern District of California Local Rule 144(a), Plaintiffs

8

and Defendant hereby stipulate that the hearing on Defendant’s Motion to Dismiss shall be moved

9

to January 23, 2013 at 9:30 a.m. Pursuant to Eastern District Local Rule 230(a) and (b), Plaintiffs’

10

opposition shall be due on or before December 5, 2012 and Defendant’s reply shall be due on or

11

before January 9, 2013.
