The stipulation to continue the hearing on defendant’s motion to dismiss or for summary
judgment filed herein on March 30, 2012, is hereby GRANTED.

IT IS HEREBY ORDERED that:

1. Defendant’s dispositive motion is continued from April 18, 2012, to June 6, 2012, at

10:00 a.m., in Courtroom 26.

2. Plaintiff’s opposition or statement of non-opposition shall be filed by no later than

20

May 16, 2012. Plaintiff’s failure to file an opposition, or to file a statement of non-opposition, will

21

be deemed a statement of non-opposition, and shall result in a recommendation that this action be

22

dismissed.

3. Defendant’s reply, if any, shall be filed by no later than May 23, 2012.
