(collectively, “Defendants”), by and through their undersigned counsel, hereby stipulate and agree to

extend the stay of the above captioned action to and including December 31, 2012, unless all of the

parties mutually agree to lift the stay at an earlier date. Plaintiff and Defendants request this extension

10

of the stay because they have reached a preliminary settlement of the consolidated state court action

11

captioned In re SureWest Commnications Shareholder Litigation, Case No. SCV-0030655, which if

12

approved by the state court will result in the voluntary dismissal of this action. Additional time is

13

needed for the parties to finalize the settlement and obtain state court approval.
