By minute order on May 16, 2016, the Court took this motion under submission without oral
argument. See Docket No. 81. To date, the Court has not issued an order on this motion.

The final pretrial conference is scheduled for July 28, 2016, with a jury trial scheduled for

September 19, 2016. See Docket No. 50. Pretrial statements and associated papers are due beginning

July 7, 2016.

The pending motion for summary judgment or summary adjudication of issues could

substantially affect the final pretrial conference issues in this case. The parties, through their

9

attorneys of record, request that the Court postpone the current briefing schedule and other pending

10

deadlines and hearings until the Court issues its order on the summary judgment motion.
