Plaintiff’s Summary Judgment on July 19, 2013. Defendant’s Response to Plaintiff’s Summary

Judgment Motion was due June 3, 2013. Unfortunately, Defendant’s counsel has been out of the office
24
during the last 3 weeks attending to a critically ill sibling and consequently needs additional time to
25
review the case and prepare a response. Counsel apologizes to the Court for his delay in filing the
26
Commissioner’s Summary Judgment Motion.
