ORDER and ORDER TO SHOW CAUSE ATHANNASIOUS, et al., Defendants. 16 17 Plaintiff Milton Sykes is a state prisoner proceeding in forma pauperis in this civil rights 18 action filed pursuant to 42 U.S.C. § 1983 and California state law. Plaintiff is represented by 19 court-appointed counsel. 20 On October 27, 2015, defendant Dr. Khaira filed a motion to dismiss pursuant to Federal 21 Rule of Civil Procedure 12(b)(6). (ECF No. 119.) A hearing on the motion is currently set for 22 December 10, 2015, at 10:00 a.m., before the undersigned. Pursuant to Local Rule 230(c), 23 plaintiff was required to file and serve an opposition or statement of non-opposition fourteen days 24 prior to the date of the hearing. However, to date plaintiff has not opposed the motion. 25 Good cause appearing, IT IS HEREBY ORDERED that: 26 1. The hearing currently set for December 10, 2015, at 10:00 a.m., is vacated. 27 2.
