The parties, through their undersigned attorneys, hereby stipulate to plaintiff’s motion for
EAJA attorneys fees pursuant to U.S.C. § 2414 (d) requesting the sum of $4,476.00.
After the Court issues an order for EAJA fees to Plaintiff, the government will consider

the matter of his assignment of EAJA fees to counsel, Mark J. Hannon. The retainer
20
21
agreement containing the assignment is attached as Exhibit 1. Pursuant to Astrue v. Ratliff, 130
22
S.Ct. 2521, 2529 (2010), the ability to honor the assignment will depend on whether the fees are
23
subject to any offset allowed under the United States Department of the Treasury’s Offset
24
Program. After the order for EAJA fees is entered, the government will determine whether they
25

are subject to any offset.
Fees shall be made payable to Plaintiff, but if the Department of the Treasury determines
that he does not owe a federal debt, then the government shall cause the payment of fees to be

made directly to counsel, pursuant to the assignment executed by Plaintiff. Any payments made
2
shall be delivered to counsel.
