Nott, hereby request an order 21 dismissing, with prejudice, ALL DEFENDANTS from the above- 22 23 24 entitled action. This request for dismissal is made pursuant to FRCP 41 (a)(2). 25 26 27 28 - 1 - The parties also agree and stipulate to the following: 1 PLAINTIFF agrees to dismiss the entire action with 2 3 prejudice as to all DEFENDANTS. 4 patronize Hurliman Boat Repair for any purpose in the future. 5 PLAINTIFF also agrees to never DEFENDANTS agree not to sue PLAINTIFF for any claims 6 7 arising out of this litigation and to waive any potential causes 8 of action they may, or may not, have against PLAINTIFF 9 concerning the facts and circumstances underlying this civil 10 11 matter. DEFENDANTS also agree to provide PLAINTIFF with a copy of each of the videotapes taken of PLAINTIFF by DEFEDANT, or 12 13 their representatives, in preparation for this litigation.
