COLVIN1, Acting Commissioner of Social Security, Defendant. 18 ) ) ) ) ) ) ) ) ) ) ) ) Case No. 2:13-CV-00570-CKD STIPULATION AND ORDER FOR VOLUNTARY REMAND PURSUANT TO SENTENCE FOUR OF 42 U.S.C. § 405(g), ___________________________________ 16 1 19 IT IS HEREBY STIPULATED by and between the parties, through their undersigned 20 21 attorneys, and with the approval of this Court, that the Commissioner of Social Security has agreed to a voluntary remand of this case pursuant to sentence four of 42 U.S.C. § 405(g). 22 Upon remand, the Office of Disability Adjudication and Review will remand this case to 23 an Administrative Law Judge (ALJ) and direct him or her to properly assess the medical 24 evidence and opinions of record and provide specific and legitimate reasons for accepting or 25 rejecting these opinions. The ALJ should re-evaluate the medical evidence with the aid of a 26 medical expert to determine the nature and severity of Plaintiff’s mental impairments, and if 27 28 necessary, the ALJ will obtain testimony from a vocational expert. Colvin should be substituted for Michael J. Astrue as the defendant in this suit.
