Plaintiff is a California prisoner proceeding pro se with an action for violation of civil
18
rights under 42 U.S.C. 1983. Plaintiff has consented to have all matters in this action before a
19
United States Magistrate Judge. See 28 U.S.C. § 636(c). By order filed August 7, 2013,
20
plaintiff’s complaint was dismissed and thirty days leave to file an amended complaint was
21
granted. The thirty day period has now expired, and plaintiff has not filed an amended complaint
22
or otherwise responded to the court’s order. Accordingly, IT IS HEREBY ORDERDED that this
23
action is dismissed without prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b).
