On December 24, 2014, the magistrate judge filed findings and recommendations herein

which were served on all parties and which contained notice to all parties that any objections to

the findings and recommendations were to be filed within fourteen days. (ECF No. 45.) Neither
23
party has filed objections to the findings and recommendations.

Because it appears that plaintiff is no longer interesting in prosecuting this case, this
25
action is hereby dismissed without prejudice for lack of prosecution.
