Plaintiff is a state prisoner proceeding in forma pauperis and without counsel. Plaintiff

consented to the jurisdiction of the magistrate judge for all purposes. 28 U.S.C. § 636(c); Local
19
Rule 305(a). (See ECF No. 12.) On November 5, 2013, this court dismissed plaintiff’s complaint
20
with leave to file an amended complaint within thirty days. Plaintiff was informed that failure to
21
timely file an amended complaint may result in the dismissal of this action. (ECF No. 13 at 7.)
22
The court’s deadline has passed, and plaintiff has not filed an amended complaint or otherwise
23
responded to the court’s order.

Accordingly, IT IS HEREBY ORDERED that this action is dismissed without prejudice. 1

Corrections and Rehabilitation, indicates that plaintiff is now incarcerated at Avenal State Prison.
