Plaintiff, a prisoner proceeding pro se, brings this civil rights action pursuant to
16
42 U.S.C. § 1983. The court directed plaintiff to show cause why the only unserved defendant –
17
Foulk – should not dismissed. In response, plaintiff has indicated that he no longer intends to
18
proceed as against defendant Foulk (see plaintiff’s response at Doc. 53). Good cause appearing
19
therefor, this action is dismissed as against defendant Foulk. See Fed. R. Civ. P. 41(a)(2).

IT IS SO ORDERED.
