IT IS HEREBY STIPULATED, by and between the parties, through their respective

counsel of record, that Defendant shall have an extension of time of an additional 35 days to

respond to Plaintiff’s motion for summary judgment. This is the first continuance sought by

22

Defendant. The current due date is July 31, 2014. The new due date will be September 4, 2014.

There is good cause for this request. The parties are engaged in settlement negotiations
and Defendant needs additional time to review the merits of this case.
