Before the court is plaintiff’s motion to withdraw deemed admissions pursuant to Rule 36
19
of the Federal Rules of Civil Procedure. (ECF No. 50.) For the reasons discussed in the May 12,
20
2015 findings and recommendations, the court will grant this motion. (See ECF No. 48 at 8-9.)
Moreover, as there is a genuine dispute of material fact as to whether defendant used
21
22
excessive force against plaintiff in violation of the Eighth Amendment (see id. at 8), the
23
undersigned will recommend that defendant’s motion for summary judgment be denied.
Accordingly, IT IS HEREBY ORDERED that plaintiff’s motion to withdraw deemed
24
25
admissions (ECF No. 50) is granted.
IT IS HEREBY RECOMMENDED that defendant’s motion for summary judgment (ECF
26
27
No. 22) be denied.
