IT IS HEREBY STIPULATED, by and between the parties, through their respective

counsel of record, that the time for Defendant to respond to Plaintiff’s Motion for Summary
21
Judgment be extended for 30 days until December 15, 2014. This is Defendant’s second request
22
for an extension of time to respond to Plaintiff’s motion. Defendant needs additional time to
23
properly address the issues raised in Plaintiff’s Motion for Summary Judgment and respectfully
24
requests this extension due to a heavy workload, including several other district court cases and a
25
Ninth Circuit case, despite due diligence.
26
The parties further stipulate that the remaining dates in the Court’s Scheduling Order
27
shall be modified accordingly.
