FOULK, et al., 17 Defendants. 18 19 Defendants have filed a motion to modify the discovery and scheduling order to extend the 20 deadline for the parties to file dispositive motions in this case. The parties are currently required 21 to file any dispositive motions on or before December 7, 2015. Defendants note, however, that 22 their motion to dismiss for failure to state a claim is still pending. On June 24, 2015, then- 23 Magistrate Judge Dale A. Drozd issued findings and recommendations, recommending 24 defendants’ motion to dismiss be granted as to defendants Foulk and Zamora but denied as to 25 defendants Kelsey and Ray. The assigned district judge has not yet issued an order adopting or 26 rejecting the findings and recommendations. 27 ///// 28 ///// 1 Good cause appearing, IT IS HEREBY ORDERED that: 2 1.
