1 2 3 4 5 6 7 8 UNITED STATES DISTRICT COURT 9 FOR THE EASTERN DISTRICT OF CALIFORNIA 10 11 SCOTT EMERSON, 12 No. 2:14-cv-0972 TLN CKD P Plaintiff, 13 v. 14 F. FOULK, et al., 15 ORDER Defendants. 16 17 On August 20, 2015, the Magistrate Judge issued an order denying Plaintiff’s motion for 18 appointment of counsel. On October 20, 2015, Plaintiff constructively filed a request for 19 reconsideration of that order. Local Rule 303(b) states “rulings by Magistrate Judges . . . shall be 20 final if no reconsideration thereof is sought from the Court within fourteen (14) days . . . from the 21 date of service of the ruling on the parties.” Plaintiff’s request for reconsideration of the 22 magistrate judge’s order of August 20, 2015 is therefore untimely. 23 Accordingly, IT IS HEREBY ORDERED that Plaintiff’s request for reconsideration (ECF 24 No. 39) is denied. 25 Dated: December 4, 2015 26 27 Troy L. Nunley United States District Judge 28 1
