Plaintiff, a county jail inmate proceeding in forma pauperis, is obligated to pay the

19

statutory filing fee of $350.00 for this action. 28 U.S.C. §§ 1914(a), 1915(b)(1). Plaintiff has

21

been without funds for six months and is currently without funds. Accordingly, the court will not

22

assess an initial partial filing fee. 28 U.S.C. § 1915(b)(1). Plaintiff is obligated for monthly

23

payments of twenty percent of the preceding month’s income credited to plaintiff’s prison trust

24

account. These payments shall be collected and forwarded by the appropriate agency to the Clerk

25

of the Court each time the amount in plaintiff’s account exceeds $10.00, until the filing fee is paid

26

in full. 28 U.S.C. § 1915(b)(2).

Good cause appearing therefore, IT IS HEREBY ORDERED that:

1. The Sheriff of Sacramento County or a designee shall collect from plaintiff’s inmate

3

trust account monthly payments from plaintiff’s inmate trust account in an amount equal to

4

twenty percent of the preceding month’s income credited to the inmate’s trust account and

5

forward payments to the Clerk of the Court each time the amount in the account exceeds $10.00

6

in accordance with 28 U.S.C. § 1915(b)(2), until the $350.00 filing fee for this action has been

7

paid in full. The payments shall be clearly identified by the name and number assigned to this

8

action.

2. The Clerk of the Court is directed to serve a copy of this order and a copy of plaintiff’s

10

signed in forma pauperis affidavit on the Sheriff of Sacramento County, Attention: Inmate Trust

11

Account, 651 I Street, Sacramento, California 95814.

3. The Clerk of the Court is directed to serve a copy of this order on the Financial

13

Department of the court.
