This is a civil forfeiture action brought against Approximately $88,340.00 in U.S. 21 Currency and Approximately $70,240.00 in U.S. Currency (collectively the “Defendant Currency”), 22 which was seized on or about November 2, 2013. 23 2. A Verified Complaint for Forfeiture In Rem (“Complaint”) was filed on June 9, 2014, 24 alleging that the defendant currency is subject to forfeiture to the United States pursuant to 21 U.S.C. § 25 881(a)(6). 26 3. On June 19, 2014, the Clerk issued a Warrant for Arrest for the defendant currency, and 27 that warrant was executed on June 30, 2014. 28 29 30 4. Beginning on May 16, 2013, for at least 30 consecutive days, the United States published 1 Final Judgment of Forfeiture 1 Notice of the Forfeiture Action on the official internet government forfeiture site www.forfeiture.gov. A 2 Declaration of Publication was filed on July 31, 2014. 3 5. In addition to the public notice on the official internet government forfeiture site 4 www.forfeiture.gov, actual notice or attempted notice was given to the following individuals: 5 a. John Walker 6 b. Arianna Walker 7 6. Claimant John Walker filed a claim alleging an interest in the Defendant Currency on 8 November 7, 2014. No other parties have filed claims or answers in this matter, and the time in which 9 any person or entity may file a claim and answer has expired. 10 Based on the above findings, and the files and records of the Court, it is hereby ORDERED AND 11 ADJUDGED: 12 1. The Court adopts the Stipulation for Final Judgment of Forfeiture entered into by and 13 between the parties to this action. 14 2. That judgment is hereby entered against claimant John Walker and all other potential 15 claimants who have not filed claims in this action. 16 3. Upon entry of this Final Judgment of Forfeiture, $88,340.00 of the Approximately 17 $88,340.00 in U.S. Currency and $22,240.00 of the Approximately $70,240.00 in U.S. Currency, 18 together with any interest that may have accrued on the total amount seized, shall be forfeited to the 19 United States pursuant to 21 U.S.C. § 881(a)(6), to be disposed of according to law. 20 4. Upon entry of this Final Judgment of Forfeiture, but no later than 60 days thereafter, 21 $48,000.00 of the Approximately $70,240.00 in U.S. Currency shall be returned to claimant John Walker 22 through his attorney Joseph M. Tully. 23 5. The United States and its servants, agents, and employees and all other public entities, 24 their servants, agents, and employees, are released from any and all liability arising out of or in any way 25 connected with the seizure, arrest, or forfeiture of the defendant currency. This is a full and final release 26 applying to all unknown and unanticipated injuries, and/or damages arising out of said seizure, arrest, or 27 forfeiture, as well as to those now known or disclosed. The parties waived the provisions of California 28 Civil Code § 1542. 29 30 2 Final Judgment of Forfeiture 1 6. Claimant waived any and all claim or right to interest that may have accrued on the 2 defendant currency. 3 7. All parties are to bear their own costs and attorneys' fees. 4 8. The U.S. District Court for the Eastern District of California, Hon. Troy L. Nunley, 5 District Judge, shall retain jurisdiction to enforce the terms of this Final Judgment of Forfeiture. 6 7 CERTIFICATE OF REASONABLE CAUSE 9. Based upon the allegations set forth in the Complaint filed June 9, 2014, and the 8 Stipulation for Final Judgment of Forfeiture filed herein, the Court enters this Certificate of Reasonable 9 Cause pursuant to 28 U.S.C. § 2465, that there was reasonable cause for the seizure and arrest of the 10 defendant currency, and for the commencement and prosecution of this forfeiture action. 11 IT IS SO ORDERED: 12 13 Dated: January 6, 2015 14 15 16 17 Troy L.
