ORDER SACRAMENTO COUNTY MEDICAL DEPARTMENT, et al., Defendants. 16 17 18 Plaintiff is a state prisoner proceeding pro se with a civil rights action filed pursuant to 42 19 U.S.C. § 1983. Plaintiff has consented to the jurisdiction of the undersigned magistrate judge for 20 all purposes pursuant to 28 U.S.C. § 636(c) and Local Rule 305(a). See ECF No. 4. On November 3, 2014, this court dismissed plaintiff’s original complaint with leave to file 21 22 an amended complaint within 28 days. ECF No. 12. Plaintiff was informed that “[f]ailure to file 23 an amended complaint will result in dismissal of this action.” Id. at 9. More than 85 days have 24 passed since the filing of the court’s order; plaintiff has neither filed an amended complaint nor 25 otherwise communicated with the court. Accordingly, for good cause shown, IT IS HEREBY ORDERED that this action is 26 27 dismissed without prejudice pursuant to Federal Rule of Civil Procedure 41(b).
