Plaintiff, a state prisoner proceeding pro se and in forma pauperis, has filed a civil rights
18
action pursuant to 42 U.S.C. § 1983. Plaintiff has consented to the jurisdiction of the undersigned
19
magistrate judge for all purposes pursuant to 28 U.S.C. § 636(c) and Local Rule 305(a). ECF No.
20
7. By order filed March 22, 2017, plaintiff’s third amended complaint was dismissed and twenty-
21
eight days leave to file an amended complaint was granted. ECF No. 38. Twenty-eight days
22
from that date have now passed, and plaintiff has not filed an amended complaint, or otherwise
23
responded to the court’s order.

Accordingly, IT IS HEREBY ORDERED that this action is dismissed without prejudice.
