The parties respectfully request that the District Court modify the Discovery and 22 Scheduling Order to continue the dispositive motion deadline for 60 days, based on good cause 23 appearing as more fully set forth below. 24 2. The Court’s Discovery and Scheduling Order originally set the dispositive motion 25 deadline for October 16, 2015. ECF No. 10. On April 20, 2015, at Plaintiff’s request, the Court 26 amended the Discovery and Scheduling Order, thereby extending the discovery deadline from 27 July 31, 2015 to August 28, 2015, and extended the dispositive motion deadline from October 16, 28 1 1 2015 to November 13, 2015. ECF No. 14. No further orders modifying the Discovery and 2 Scheduling Order have been entered. 3. 3 The parties are in good faith attempting to resolve this matter and are in the 4 process of negotiating a settlement. In an attempt to avoid the time and expense of preparing and 5 opposing a motion for summary judgment, the parties respectfully request that the dispositive 6 motion deadline be continued for 60 days to allow the parties time to hopefully resolve this 7 matter. 4. 8 9 10 Therefore, the parties respectfully submit that good cause exists to amend the dispositive motion deadline of the Discovery and Scheduling Order dated April 20, 2015 (ECF No. 14) as follows: Deadline 11 Old Date Dispositive motion deadline November 13, 2015 New Date January 13, 2016 12 This Stipulation may be signed in counterparts and any facsimile or electronic signature 13 14 shall be as valid as an original signature. 15 IT IS SO STIPULATED. 16 Dated: November 9, 2015 17 By 18 19 /s/ THOMAS O.
