ORDER JOE LIZARRAGA, Warden, Respondent. 16 17 Petitioner filed a petition for a writ of habeas corpus on August 1, 2014. ECF No. 1. That 18 petition was dismissed without prejudice as a successive petition by Order of the District Judge 19 on October 15, 2014, ECF No. 8, and judgment was entered the same date. ECF No 9. On 20 March 28, 2018 petitioner filed motions to appoint counsel, to “reopen” the case, and for 21 discovery. ECF No. 11. 22 This action remains successive, and attempting to append a new claim to a successive 23 petition does not render it non-successive.
