WHEREAS, the Parties have resolved this matter. Pursuant to Rule 41 of the Federal
Rules of Civil Procedure, Plaintiff LORI PHILLIPS and Defendants TOYS “R” US, INC., and

with prejudice. Each party is to bear its own costs and attorneys’ fees.
