This matter came before the Honorable Judge Dale A. Drozd on the United States’
18 ex parte motion for default judgment. There was no appearance by or on behalf of any
19 other person or entity claiming an interest in the above-captioned defendant currency to
20 oppose the United States’ motion. Based on the United States’ motion and the files and
21 records of the court, THE COURT FINDS as follows:
22
1.
This action arose out of a Verified Complaint for Forfeiture In Rem filed
23 September 4, 2014.
24
2.
The United States has moved this Court, pursuant to Local Rule 540, for
25 entry of default judgment of forfeiture against potential claimants Tasha Boutte, Keidric
26 Rouege, Sigrid Rouege, Rachel Leah Rouege, and Michael Rouege.
27
3.
The United States has shown that a complaint for forfeiture was filed; that
28 potential claimants Tasha Boutte, Keidric Rouege, Sigrid Rouege, Rachel Leah Rouege,
1
Findings and Recommendations
29
1 and Michael Rouege received notice of the forfeiture action; that any and all other
2 unknown potential claimants have been served by publication; and that grounds exist for
3 entry of a final judgment of forfeiture.
4
Therefore, IT IS RECOMMENDED as follows:
5
1.
That Tasha Boutte, Keidric Rouege, Sigrid Rouege, Rachel Leah Rouege, and
6 Michael Rouege be held in default;
7
2.
That the United States’ motion for default judgment and final judgment of
8 forfeiture be granted;
9
3.
That judgment by default be entered against any right, title, or interest of
10 potential claimants Tasha Boutte, Keidric Rouege, Sigrid Rouege, Rachel Leah Rouege,
11 and Michael Rouege in the Defendant Currency referenced in the above caption;
12
4.
That a final judgment be entered, forfeiting all right, title, and interest in
13 the defendant currency to the United States, to be disposed of according to law;
14
5.
That the Default Judgment and Final Judgment of Forfeiture lodged herein
15 be signed by the Honorable William B. Shubb and filed by the Clerk of the Court.
